Defense and prosecution of commercial and residential landlord-tenant disputes from commencement through trial, including complex holdover and non-payment proceedings. Claro PLLC regularly provides legal counsel to building owners, cooperative and condominium boards, as well as cooperative shareholders, condominium owners and tenants. In addition, Claro PLLC regularly engages in litigation in New York State’s Supreme Courts involving the commencement and defense of declaratory judgment actions including emergencyYellowstone injunctions.

Loft Law

 

Litigation and counseling involving the New York City Loft Law (Article 7-C of the New York Multiple Dwelling Law), including negotiation and preparation of sale of rights agreements and conducting of trials at the Office of Administrative Trials and Hearings (“OATH”).

Foreclosures

Defense of foreclosure actions commenced against commercial and residential building owners related to allegations of monetary and non-monetary mortgage defaults.

Contracts

 

Drafting, review and negotiation of commercial and residential real estate contracts, including counseling clients through corporate governance issues, and, currently, COVID-19-related lease discharge negotiations.

General Counsel

 

Provide general counsel to building owners and boards related to building management and related government registration issues. Claro PLLC also counsels clients through responding to investigatory subpoenas issued by the New York State Attorney General’s office and conducts due diligence for the sale and purchase of real property.

Commercial Litigation

Involved in all stages of litigation, from drafting pleadings and conducting discovery, including e-discovery, through the preparation and argument of substantive and procedural motions, and trial.

Preparation and perfection of appeals before New York’s appellate courts, including oral argument.
